How the Audit Is Conducted

Before 2020, safety auditors physically visited your place of business. Today, over 90% of new entrant audits are conducted virtually through the FMCSA Safety Audit Web System (SAWS).

You receive an official letter and email giving you 30 days to log into the online portal and upload digital copies (PDFs) of your company records across six primary compliance areas. The 4 Mandatory Folders You Must Have Ready

1. Driver Qualification (DQ) File

Even if you are the sole owner and only driver of your LLC, you must have a complete DQ file on yourself. You cannot skip this because "I work for myself." Your folder must contain:

  • Completed Driver Employment Application (meeting 49 CFR § 391.21 standards).
  • Copy of valid CDL (front and back).
  • Valid Medical Examiner's Certificate (DOT Medical Card) registered with your state DMV.
  • Annual Motor Vehicle Record (MVR) pulled within the last 12 months.
  • Annual Certificate of Violations and Annual Review of driving record.
  • Previous 3-year commercial safety employment verification inquiries.

2. Drug & Alcohol Compliance File

  • Proof of enrollment in an approved Random Drug & Alcohol Testing Consortium (e.g., OOIDA, Foley, CleanFleet).
  • Negative pre-employment drug screen result letter from an authorized Medical Review Officer (MRO).
  • FMCSA Drug & Alcohol Clearinghouse pre-employment full query confirmation.
  • Company written Drug & Alcohol Educational Policy receipt signed by the driver.

3. Vehicle Maintenance and Inspection Records

  • Current Annual DOT Inspection Certificate for your tractor (performed within last 12 months).
  • Current Annual DOT Inspection Certificate for your trailer (inspections are separate!).
  • Proof of scheduled preventive maintenance (oil changes, brake adjustments, grease jobs with dated work orders and VIN).
  • Driver Vehicle Inspection Reports (DVIRs) for any trip where a defect was noted and repaired.

4. Hours of Service (HOS) and ELD Records

  • Past 6 months of electronic driver logs pulled from your ELD provider (Motive, Samsara, Garmin).
  • Supporting documents verifying your log accuracy (fuel receipts with timestamps, toll transponder records, shipping BOLs). Auditors cross-reference your fuel card swipe times with your ELD "On Duty" logs to catch log falsification.

What to Do If You Receive an Audit Notice

  1. Acknowledge the Notice Immediately: Never ignore the letter. Log into the SAWS portal within 48 hours to confirm receipt.
  2. Review Your Files for Missing Signatures: Ensure your medical card, annual inspections, and consortium membership are active and dated properly.
  3. Upload Clean, Labeled PDFs: Name your files clearly (e.g., Tractor_Annual_Inspection_2026.pdf). An organized upload makes the auditor's job easy and sets a professional tone.

Once you pass, your carrier status remains in good standing, and at the 18-month mark, your authority automatically graduates to permanent status.
